5. Payment Terms

5.1 Pricing

All prices displayed on our Site are in United States Dollars (USD) and are subject to change without notice. Applicable taxes, delivery fees, and service charges will be calculated and displayed at checkout prior to the finalization of your order. You are responsible for all charges incurred through your account, including applicable taxes and fees.

5.2 Payment Methods

5.3 Order Confirmation

If your order is cancelled after payment has been processed, you will receive a full refund through your original payment method.

5.4 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been prepared. We will review your concern on a case-by-case basis and may, at our sole discretion, offer a replacement, store credit, or partial/full refund as appropriate. Cancellation requests must be submitted before your order enters the preparation stage. We cannot guarantee cancellations after preparation has begun.

5.5 Chargebacks

If you initiate a chargeback or dispute with your payment provider without first contacting us in good faith to resolve the matter, we reserve the right to suspend or terminate your account and take any other action permitted by law.

6. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR SITE, SERVICES, AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GREEN LANTERN PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
• DAMAGES ARISING FROM YOUR INABILITY TO ACCESS OR USE THE SITE OR SERVICES;
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
• DAMAGES ARISING FROM THE CONDUCT OF ANY THIRD PARTY ON OR THROUGH THE SITE.

THESE LIMITATIONS SHALL APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF GREEN LANTERN PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO GREEN LANTERN PIZZA IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

8. Indemnification

You agree to defend, indemnify, and hold harmless Green Lantern Pizza and its officers, directors, employees, agents, contractors, licensors, suppliers, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or any applicable law or regulation;
• Your violation of any rights of any third party, including intellectual property rights, privacy rights, or contractual rights;
• Any User Content you submit to or through our Site;

To the extent that any claims or disputes are not subject to arbitration (as described in Section 10 below), you consent to the exclusive personal jurisdiction and venue of the federal and state courts located in the United States and, more specifically, within the state where Green Lantern Pizza maintains its principal place of business, for the resolution of any disputes arising out of or related to these Terms or your use of our services.

Our services are intended for use by individuals located within the United States. We make no representation that the Site or its content is appropriate or available for use in other locations. If you access our Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

These Terms are subject to compliance with all applicable federal laws, including but not limited to the Federal Trade Commission Act (FTC Act) governing unfair or deceptive acts or practices in commerce, and applicable state consumer protection statutes.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our services by contacting us informally at [email protected]. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If the dispute is not resolved within that period, either party may pursue formal dispute resolution as described below.

10.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for disputes that qualify for small claims court and except as otherwise set forth herein, you and Green Lantern Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are incorporated herein by reference. The arbitration shall be conducted in English and shall take place in the state where Green Lantern Pizza maintains its principal place of business, unless otherwise mutually agreed upon.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines that one party's claims or defenses were frivolous, in which case the arbitrator may award attorneys' fees and costs to the prevailing party.

10.3 Class Action Waiver

YOU AND GREEN LANTERN PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, YOU AND GREEN LANTERN PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL.

10.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.

11. Term and Termination

11.1 Term

These Terms shall remain in full force and effect while you use our Site or services or while you maintain an account with us.

11.2 Termination by You

You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account will not relieve you of any obligations or liabilities incurred prior to termination.

11.3 Termination by Us

We reserve the right, in our sole discretion, to suspend or terminate your access to our Site and services at any time and for any reason, including but not limited to:

• Suspected fraudulent, abusive, or illegal activity;
• Failure to pay for services rendered;

Customers with severe allergies or specific dietary requirements are strongly encouraged to contact us directly before placing an order to discuss ingredient information and preparation methods. Green Lantern Pizza shall not be liable for any allergic reactions or adverse health effects resulting from the consumption of our food products where you have failed to disclose known allergies or have not sought appropriate medical advice.

16. Alcohol (If Applicable)

In the event of such a force majeure event, we will make reasonable efforts to notify affected customers and resume normal operations as soon as practicable.

18. Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, unlawful, void, or unenforceable for any reason, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.

Furthermore, the parties agree to attempt to replace any invalid or unenforceable provision with a valid and enforceable provision that most closely approximates the intent and economic effect of the original provision.

21. Assignment
